Michigan Townships Association issued the following announcement on Nov. 20.
Nov. 20, is the start of the new township term of office. It is MTA’s position, based on our legal counsel guidance, that the oath of office can be taken virtually. Among the basis for this opinion is the statutory and constitutional language used, other types of legal oaths that can be taken virtually, and the new statute authorizing notaries (who may administer the oath) to take actions electronically. MTA believes the administration of the oath should be done visually—by some form of video (not audio only)—that allows both the oath taker and oath giver to see one another. Note that a person taking the oath must sign either the oath book or an “oath slip” that is filed with the township clerk. An oath slip can be mailed or delivered to the clerk after it is signed. MTA has an Oath Fact Sheet that includes sample oath slips. You may wish to consult with township legal counsel for additional guidance.
